Terms and Conditions for Refinerack

1. Acceptance of Terms

By accessing or using the Refinerack platform, web application, and related services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.

2. Platform Description

Refinerack is a Software as a Service (SaaS) platform providing digital menu parsing, table management, order tracking, and an AI-powered waiter assistant for restaurants and their patrons.

3. Account Registration and Security

• Authentication: Access requires phone number verification via OTP. You are responsible for maintaining the confidentiality of your session, device, and OTPs.
• Roles: The platform grants different permissions based on your assigned role (e.g., Owner, Admin, Manager, Waiter, Cook, Host, or Customer). You agree not to bypass, manipulate, or attempt to escalate your role capabilities.

4. Restaurant Partner Responsibilities

If you are a restaurant owner, admin, or authorized staff member:

• Menu Accuracy & Allergens: You are strictly responsible for the accuracy of the menu data uploaded to the platform, including dietary markers (Veg/Non-Veg/Egg), ingredient lists, and allergen warnings.
• AI Blueprint Verification: Our system uses Google Gemini to generate an "Executive Chef Blueprint" from your uploaded PDFs. You must review and verify this blueprint for accuracy. We are not liable for incorrect AI suggestions arising from inaccurate or incomplete menu source data provided by you.
• Staff Actions: You are responsible for the actions of your staff members on the platform. The platform provides an immutable audit trail of order events for your operational oversight.

5. Customer Responsibilities

If you are a dine-in customer:

• Table Joining: You may be required to provide a name and phone number to request a join code from restaurant staff. You agree to provide accurate information.
• Billing: The platform computes and tracks your bill summary. You are responsible for settling your final grand total with the restaurant before leaving. Refinerack is not a payment gateway and is not liable for payment disputes between you and the restaurant.

6. Artificial Intelligence (AI) Waiter ("Raju") Disclaimer

• Our AI Waiter provides recommendations, food pairings, and service interactions based on the restaurant's blueprint.
• Not Infallible: While we implement strict cultural and dietary guardrails (e.g., pure vegetarian table isolation, egg vs. veg segregation), the AI is an automated assistant, not a human.
• Allergy Warning: Customers with severe allergies must always verify ingredients directly with human staff. Refinerack is not liable for allergic reactions, dietary breaches, or health issues resulting from AI suggestions.

7. User Content and Intellectual Property

• Content License: By uploading menus (PDFs, images) or providing chat inputs, you grant Refinerack a non-exclusive license to parse, modify, and transmit this data (including via third-party APIs like Google Gemini) to provide and improve the service.
• Platform IP: The Refinerack platform, its architecture, AI logic, and codebase remain our intellectual property. Reverse engineering, scraping, or unauthorized copying is strictly prohibited.

8. Acceptable Use Policy

You agree not to:

• Interfere with the platform's transaction limits or concurrency rules (e.g., repeatedly spamming join codes or OTP requests).
• Upload malicious files, bypass file size limits, or exploit the temporary storage upload system.
• Submit abusive, prohibited, or illegal prompts to the AI Waiter.

9. Limitation of Liability

To the maximum extent permitted by law, Refinerack shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data loss, or business interruption, arising out of your use of the platform. Our maximum aggregate liability is limited to the amount paid by you to us for the service in the three (3) months preceding the claim.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the platform constitutes acceptance of the updated Terms.
